Welcome to the Celtic Feast of Brigid.  Danu and Dagada are so proud. The best thing you can do, since you don’t have a Spring is adorn your tub.  Once adorned, you really should make love next to it but I know how difficult that can be for some of you.

Monday May 20th:  Anybody look at the polling places for the Utica School District Race??  You should. Looks like somebody is intentionally getting screwed.

Tuesday May 21st:  The District Attorney needs an update on the voter fraud story.  If Mr. Truett ran a tighter ship, this wouldn’t be necessary.

Wednesday May 22nd:  The Enforcement folks at the State Board of Elections also need an update.  They sounded so happy on the phone.

Thursday May 23rd:  Remember when I FOIL’d the Liberty Street addresses??  I think the Camden folks should know how close they came to becoming famous.

Friday May 24th:  The Oneida County Clerk and the Utica Tax Assessor need to make a decision before a court does.  Time to bring them to the table.

Dear Enforcement Administrator Farina:


The other day I was at the Oneida County Board of Elections.  I asked if anyone was registered at 10 Liberty Street. They indicated 2 people were registered at that address.


This is a problem for a number of reasons.  Because it is so serious, I have sent the following FOIL to check out the information


The property is zoned Highway Commercial.  Therefore, it is not not zoned for residency and does not have a Certificate of Occupancy.  


While it is true that the bottom floor has electricity and the second floor has a full living space including full kitchen and bedroom, we have no idea if power is available to those floors.  We must surmise, since it would be a felony level crime otherwise, that owner Brett Truett does not know these people exist. It would be a shame for the city to allow two people to squat in a house and possible cause a fire.


Thanks to your work, the Utica Codes Department, unlike some others in the area, has an excellent reputation.  Please see the following for clarity:


Therefore, I am asking you to go check out the property.  That way, we can determine whether voter fraud is going on.  Secondly, we can possibly prevent property damage.

Re: Freedom of Information Law Request for Records


Dear Madam Commissioner:

Under the provisions of the New York Freedom of Information Law, Article 6 of the Public Officers Law, I hereby request a copy of records or portions thereof pertaining to or containing the following:


I am interested in two 10 Liberty Street properties.  I would like to see the names and Party designations, by providing the information from the general roster of voters so you need not make a list, for all persons registered at 10 Liberty Street, Camden, New York.  I would like the same information for all persons registered at 10 Liberty Street, Utica, New York. I would also like a copy of any entire ballot petition that the names involved in the 10 Liberty Street, Utica address appear on.


I understand there is a fee of $.25 per page for duplication of the records requested. (If the fee exceeds $100 , please contact me before duplicating the records.)


As you know, the Freedom of Information Law requires that an agency respond to a request within five business days of receipt of a request.  If you team is currently buried under other tasks, or the Tax Assessor’s team is stretched thin, please let me know and we can work something out to benefit all.


If for any reason any portion of my request is denied, please inform me of the reasons for the denial in writing and provide the name and address of the person or body to whom an appeal should be directed.

Dear Madam Clerk:


I hope this message finds you well.  This request was originally intended for the Utica Tax Assessor.  However, my research of state law on the issue I am about to present suggests that County Tax records are the “official documents”.


I refer you to the tax record for 126 Burchard Street, Utica NY.  It says the owner is Brett Truett. It lists has current address as “10 Liberty Street Utica, NY”.  Therein lies the problem: that cannot be his address and still be a faithful record of the facts..


10 Liberty Street is zoned as Highway Commercial.  By definition, as “current address” is defined in the state of New York, it cannot be anyone’s address.  That would include the two people that are apparently registered to vote there.


Do not feel bad as Mr. Truett plays this game all the time.  A FOIL request is supposed to reflect your current residence.  The last time he sent one to the Clerk for the City of Utica, in 2016, he once again used 10 Liberty Street.


In fact, because it cannot be a “residential listing”, 10 Liberty Street cannot even be a temporary address.  If Mr. Truett wishes to hide so much and not be transparent, he should rent a hotel room, at least that is a temporary location, and use that as his temporary address.


Mr. Truett has spent a number of consecutive years demanding transparency of others yet engaging in none himself.  This Liberty Street debacle is just another example. In order to get him to follow our laws, we must start somewhere.


Therefore, I request that you request of him, within a reasonable deadline, the actual address he lives at.  It has to be zoned residential. To be fair, he has to spend at least 150 nights a year there. Otherwise, someone with much worse intentions can take advantage of the Truett situation and create much bigger headaches.
