Dear Mr. Bergeron:

This is a request under the Massachusetts Public Records Law (M. G. L. Chapter 66, Section 10). I am requesting that I be provided a copy of the following records:

Any written or electronic communication, including emails and texts, sent by or on behalf of Massachusetts DDS Director for the Southeast Region Rick O’Meara to any AFSCME member.  I would also like to see all communications by or on behalf of Mr. O’Meara where any AFSCME members were mentioned. I would like the search range to include the period starting 1 June 2018 and ending 29 September 2018.

I recognize that you may charge reasonable costs for copies, as well as for personnel time needed to comply with this request.

The Public Records Law requires you to provide me with a written response within 10 business days. Due to the size and nature of the request, reasonable extra time is understandable.

A Week of Followups

Today we celebrate Eyvind Kelve.  He wanted to be a Pagan Priest. The king didn’t want him to be.  Therefore, the king killed the 29 year old.

 

Our current Pope is going through some of the same stuff.  If you wonder how I feel about our Jesuit Pope, just remember that I share a birthday with a Founder of the Jesuits.

 

Instead of just letting the Pope do his thing, a bunch of “conservatives” want him to abdicate.  I put “conservative” in quotes because much like Cardinal Dolan and Bishop Tobin, nothing about these people is truly conservative.  For the most part, they are gay people with an interest in children who tell others not to be gay. Sadly there are some, like the Senate President in Rhode Island, will stab women in the back to please this class of miscreants.

 

Our church is built on Pagan traditions.  The Jesuits not only know it, they teach it.  This teaching scares those “conservative” types who only major in hypocrisy.



Monday May 6th: Time to re-file on behalf of one of my favorite AFSCME members.  We have spent weeks negotiating time windows.

Tuesday May 7th: Who is Richard G. Wohnsen??  Why does he own that property with Bruett Truett??  We need to take the first step on this little journey.

Wednesday May 8th: Remember when I got broken into and all my stuff got stolen??  I do. Time to ask the Police Chief over in Kirkland if he’s still holding to his original finding or if he’d like to appear as a reasonable human being.

Thursday May 9th: Are people voting out of a certain building zoned Highway Commercial??  Are other people mad that they’ve been dragged into a mess they didn’t start??

Friday May 10th: If people are illegally living in the building mentioned above, isn’t that a matter for the Utica Codes Department??  I think it is.

Please be aware, as we discovered many times, that this is only a schedule and real events can happen.  However, I’m trying to get back to the old days where more Blogs appeared and not less. This week, expect follow-ups and updates along the way.

Under the provisions of the New York Freedom of Information Law, Article 6 of the Public Officers Law, I hereby request a copy of records or portions thereof pertaining to or containing the following:

 

Any written or electronic communication that took place during the time period 1 July 2018 to the present between any representative of the Mortimer and Mimi Levitt Foundation, aka the Levitt and Grant Awards, and any employee of the city of Utica or Michelle Truett in her role as representative of the city of Utica.

 

I understand there is a fee of $.25 per page for duplication of the records requested. (If the fee exceeds $100 , please contact me before duplicating the records.)

 

As you know, the Freedom of Information Law requires that an agency respond to a request within five business days of receipt of a request.  In this particular case, due to the particular size of the request and the amount of time it might take your team to calculate the fee, please take all the reasonable time you need.

 

If for any reason any portion of my request is denied, please inform me of the reasons for the denial in writing and provide the name and address of the person or body to whom an appeal should be directed.

An Update with a Story to Follow

Well, the County Clerk’s Office reached out to me today.  They said they sent that letter down to Finance and Finance rejected it saying it was the Tax Assessor’s job.

I called the Tax Assessor.  His team said that because forms, I’m going to get these numbers wrong, 584 and 5713 are filed with the County at the time a sales is completed, it’s the County’s job.

I called County Finance directly and explained the guidance I have been given.  County Finance personnel said they would talk to a Deputy Commissioner.  They also said they would mention the state laws I cited.

Frankly, I don’t care who does it.  Yes, state law says it is a County task but if things work better for us in Oneida County having the municipalities do it, that’s cool by me.  In any event, they have to get together and make sure the Brett Truetts of the world follow the law.

Suit-Kote

That’s the heart of this.  Brett, Jim Brock, Ken Roser, Claudia Tenney, David Gordon, and Jim Zecca will all fill the victim role.  Meanwhile, they will skip around guidelines you have to follow.  (Later this week you’ll see what another Claudia Tenney supporter, Dusty Dwyer, is getting away with over in Kirkland via this strategy.)

Mind you, they will continue to do it until somebody gets in their face.  I guess that time is now.

 

A Note to My Readers

  1. Thanks for coming back and hanging out.  Most of you are reading 2 and 3 posts a day.  That’s awesome.
  2. Another side effect of the LuVox??  Less typos.  I know some of you love the writing but hate the mania related typos.  It took me 35 years to get sober, another 10 to find out I was Bipolar, and 7 more to discover LuVox.  I can’t even express how great this feels compared to every other minute being trapped in an OCD loop.
  3. Yes, now that the typos are slowing down, I will fix that other blog from the other day.  Obviously, my resume was written before LuVox.
  4. Why this picture??  It’s a sneak peak at what is coming Friday.  Sssssshhhhhhhh- don’t tell anybody.

Transparency Anyone

Dear Madam Clerk:

 

I hope this message finds you well.  This request was originally intended for the Utica Tax Assessor.  However, my research of state law on the issue I am about to present suggests that County Tax records are the “official documents”.

 

I refer you to the tax record for 126 Burchard Street, Utica NY.  It says the owner is Brett Truett. It lists has current address as “10 Liberty Street Utica, NY”.  Therein lies the problem: that cannot be his address and still be a faithful record of the facts..

10 Liberty Street is zoned as Highway Commercial.  By definition, as “current address” is defined in the state of New York, it cannot be anyone’s address.  That would include the two people that are apparently registered to vote there.

 

Do not feel bad as Mr. Truett plays this game all the time.  A FOIL request is supposed to reflect your current residence.  The last time he sent one to the Clerk for the City of Utica, in 2016, he once again used 10 Liberty Street.

 

In fact, because it cannot be a “residential listing”, 10 Liberty Street cannot even be a temporary address.  If Mr. Truett wishes to hide so much and not be transparent, he should rent a hotel room, at least that is a temporary location, and use that as his temporary address.

 

Mr. Truett has spent a number of consecutive years demanding transparency of others yet engaging in none himself.  This Liberty Street debacle is just another example. In order to get him to follow our laws, we must start somewhere.

 

Therefore, I request that you request of him, within a reasonable deadline, the actual address he lives at.  It has to be zoned residential. To be fair, he has to spend at least 150 nights a year there. Otherwise, someone with much worse intentions can take advantage of the Truett situation and create much bigger headaches.
